TRANSREC TERMS AND CONDITIONS

  1. Definitions
    1.1. Agreement refers to these Terms and Conditions, including the Service Agreement, Software Application Services, and associated GPRS services.
    1.2. Asset denotes any vehicle, motorcycle, plant, equipment, or marine vessel fitted with a Transrec device.
    1.3. Transrec Device means any GPS tracking unit utilising satellite and GPS technology, including future versions or updates.
    1.4. GPRS Service Provider refers to telecommunications providers such as Optus, Vodafone, and Telstra, or others that may be appointed.
    1.5. Business Management Services denotes the communications services enabling the Transrec device to transmit data to the Transrec platform.
    1.6. Coverage Area refers to the geographic reach of GPRS signals as defined by the selected provider.
    1.7. Third-Party Equipment means any hardware supplied by entities other than Transrec, used in conjunction with the Transrec system.
    1.8. User Manual and Installation Manual includes both printed and digital documentation detailing the operation and installation of Transrec devices and related services.
  2. Installation and Usage
    2.1. The Customer agrees to use the Transrec system in strict accordance with all provided manuals and ensure that all authorised users are properly trained.
    2.2. The Customer must keep login credentials confidential and not share them with unauthorised personnel.
  3. Tracking and Data Services
    3.1. Upon payment of a management or tracking service fee, Transrec shall provide the Customer with live tracking access and software updates.
    3.2. All software, data, and generated reports remain the property of Transrec and are licensed to the Customer only while payments are current.
    3.3. Non-payment may result in restricted access to services.
    3.4. Historical tracking data is maintained only while the asset remains on an active tracking plan.
  4. Pricing and Payments
    4.1. Title in the devices passes only upon full payment.
    4.2. By opting for direct debit, the Customer authorises Transrec to withdraw due amounts on the scheduled dates.
    4.3. Credit card users must notify Transrec of lost, stolen, or expired cards immediately.
    4.4. In cases of non-payment, recovery costs including collection fees and legal charges may be borne by the Customer.

 

  1. Risk and Liability
    5.1. Transrec is not liable for service interruptions due to force majeure, including but not limited to software issues, signal interference, or third-party failures.
    5.2. The Customer assumes full risk for performance limitations arising from such factors.
    5.3. Malfunctions related to Third-Party Equipment are the responsibility of the third-party supplier.
    5.4. Payment obligations remain until formal service cancellation is submitted in writing, subject to Clause 7.
    5.5. Customers must comply with applicable surveillance and privacy laws in their jurisdiction.
  2. Change of Ownership
    6.1. The Customer must inform Transrec if the tracked asset is sold, transferred, or leased to a third party. Services can only be transferred via new agreement.
  3. Termination
    7.1. The Customer may terminate the agreement with 30 days’ written notice. Prepaid service fees are non-refundable.
    7.2. Transrec may terminate the agreement in writing and refund any unused service fees on a pro-rata basis.
    7.3. All remaining device or service costs must be settled upon termination.
  4. Orders and Activations
    8.1. Orders are binding only when submitted via email or a signed purchase document.
    8.2. SIM card activations will occur only after valid customer details are received.
  5. Warranty
    9.1. Transrec provides a limited warranty ranging from 12 to 36 months, depending on the specific product. This warranty covers manufacturing defects and includes repair or replacement at Transrec’s discretion.
    9.2. Warranty does not extend to failures resulting from external telecommunications or environmental conditions.
    9.3. Warranty becomes void if:
  • Unauthorised modifications or tampering occurs.
  • Damage results from natural disasters, misuse, or criminal activity.
  • Failures arise from third-party systems or software conflicts.
    9.4. Third-party equipment is not covered under this warranty, but any applicable warranties will be passed to the Customer.
  1. Wireless and Internet Coverage
    10.1. Wireless coverage maps are indicative only and may be affected by physical obstructions.
    10.2. Transrec is not liable for limitations or downtime of satellite, internet, or wireless networks used in service delivery.
  2. GPS and Location Data
    11.1. The GPS system used is maintained by the U.S. Government. Transrec disclaims liability for outages, inaccuracies, or performance changes resulting from changes in the GPS system.
    11.2. Location data is stored on Transrec servers and made available via a secure online platform.
